A Zamboni driver, who was charged with DUI for drunk-driving on an ice rink, has won his fight to have his license revocation overturned. The judge says a Zamboni technically isn't a motor vehicle because it can't be operated on a road and can't carry passengers.
From the story: Peragallo, 64, testified at his trial that he did drink beer and vodka, but not until after he had groomed the ice. However, he told police he had a shot of Sambuca with his breakfast coffee and two Valium-pills before work.

Should he be fired? Sure. Should he be prosecuted for DUI? No way. He was guilty of operating machinery at work under the influence, but not of operating a motor vehicle on a roadway.
Thank goodness for the protection of civil liberties! I think to celebrate I'll put on my shorts, black socks and sandals, pop a beer and hop onto the lawn tractor...
