Not true that they would have to be "proven to have broken the law", as you say. An indictment is a formal accusation of having committed an illegal act. The proof comes after the arrest in a court.

The beauty of anything illegal that the Bush administration has done is that its all covered with the red tape of national security. Even the suits over the warrantless wiretaps, which were illegal, can't get anywhere because the Justice Dept., under the umbrella of national security, has been given a free ride by the courts blocking the subpoena of records to find out who was actually spied upon. The statutes of limitations will have long passed by the time the illegal acts (warrantless clandestine espionage, torture, etc.) by the time the documents that prove any of it become declasified.
