15 years for murdering KC bicyclist

From Mark Morris: A Jackson County judge sentenced a Kansas City man to 15 years in prison for the November 2005 shotgun slaying of a cyclist. Fabian Brown Jr. elected not to address Judge Jay Daugherty before hearing his prison term for second-degree murder and armed criminal action.

Family members of the victim, Robert W. Osborn, urged Daugherty to throw out the plea bargain and bring the case to trial, in hopes that Brown would get a life sentence. Afterward, Osborn’s brothers said they were not happy with the plea agreement, which capped Brown’s possible sentence at 20 years.

... At his plea hearing in October, Brown said he and co-defendant Rapheal L. Willis killed Osborn near 47th Street and Blue Ridge Boulevard because they saw him ride by on a bike.

Brown said he fired two shots from a hunting rifle but missed. He and Willis didn’t stop or speed away, he said. Instead they drove down the road and ambushed Osborn, this time killing him with a 12-gauge shotgun.

Don't blame the judge, he simply sentenced to what was agreed to by the PROSECUTOR.

I always blame the judge, he has to agree with the prosecutor. I'd like to see more judges get thrown in jail who think there $h*t doesn't stink.

One, this judge is a good & decent guy -- stuck in the world's toughest job when it comes to stuff like this.

Before you people start banging on judges again feel free to educate yourself a little about the process.

Yep, he admitted to lots of horrible things; i.e. stalking the guy, shooting him because he was bored etc. But, do you really think he would have admitted any of that absent the plea bargain? If you think the PA had a legit confession to these things and then offered the deal he pled to, you're crazy.

Most likely there was a problem of some nature with the PA's case and they felt compelled to get what they could via plea bargain. I suppose it would be better to not do plea bargains at all and watch a distressing number of these fools walk with no repercussions whatsoever?

Given that there was a plea in place the judge sentenced him in accordance with that plea. Does it mean the judge likes and agrees with the plea. Not necessarily. But if judges start arbitrarily not accepting pleas the whole process breaks down and, like we talked about before, a lot of these scumbags will wind up with a walk.

Unfaqing believable!!!! Bottom line is that these MF went hunting for a human being. When I heard this story it gave me chills because of how they just picked a random person. Got 15 years? So, in 12 years with the possiblity of less, this MF is going to be a resident of Missouri....and second degree? how? wow? After missing him with the first few shots, you would think they would reconsider what they were doing, but no, they hunted him down. If anybody deserves the death pemalty, its these clowns. That's why I don't beliece in the death penalty because of judicial system is all the was azz backwards.

Because this crime was cold-blooded, heartless, stupid and pointless, the 'plea bargain' should have been to get life instead of the death penalty.
I don't care how you parse it, 15 years is not an appropriate punishment for such a heinous act.
Oh, and I agree with the comment above about marijuana laws. Its high time (no pun intended) that we stop locking people up for such spurious non-violent behaviors.
