Everybody who's gotten a DWI says the same thing, "I wasn't drunk, the breathalyzer was".

Probably wasn't any more accurate at measuring his own blood alcohol level than any other Breathalyzer.

People can become involuntarily intoxicated by Roofies, GHB, spiked drinks, etc.
And Tom's a scientific genius, too.
