Glade Potpourri, if you were curious. The suspect is unrepentant, the police say, and vows to keep spraying the woman who keeps smoking outside her building apartment. From Northwest Florida Daily News:
The woman then pointed the air freshener at the back of the other woman’s head and sprayed the air freshener directly to the back of her head for almost one minute, according to the report.
The woman said to the other woman, “I will do it again, and take it to the Supreme Court because I have the right to breathe fresh air,” the police report said.


It's not really fresh air she was spraying around that can of air fresher has chemicals in it just like the cigarettes do.

The person is going outside to smoke a cigarrette, she could stay in her apartment and then the smoke smell would permeate the inside of the building, I would ask her which way she would like her nicotine.

I really don't understand why the woman was going OUTSIDE to spray the "freshener."
Sounds like the woman is just a trouble maker.. It's not like the woman (smoking) was standing outside her apartment door..

Strikes me that the sprayer may be an ex-smoker that has gone to the other extreme. Since they quit, everyone must quit in a 250 mile radius of them.

James, did the incident(s) happen outside the building, as you wrote, or, outside this womans apt? It makes a big difference as to who is in the wrong here.

I can't say too much when it comes to smokers because most are considerate and I know most of them would like to quit, but can't. Non smokers tick me off more than the smokers anyway. But the sense of smell brings out powerful emotions positive and negative, depending the associated experience with the smell.
I know one woman who tears up every time she smells old spice aftershave, because it instantly bring back old memories of her dad who never came home from Vietnam.

She should have put a bag over that woman's head and let her breathe in that Cancer even deeper. Non smokers have a right to pollutant free air and we should not have to shut out windows to avoid cancer smoke.
Cigarettes should be regulated and taxed out of existance. Talk about a drain on health care.

So I still don't know... was this OUTSIDE literally and her door opens to the outside (fresh air) or INSIDE (but outside her apartment door. Some apartments have a main entry, but doors are all inside a main hallway.
It does make a difference and the supreme court or any court would look at multiple factors.
I would have to know why it is ok to smoke outside but not spray air freshener.
And, did the lady blow smoke on her... thus she sprayed her.
And, why did she stand there for a minute and take it.
I agree with Nemisis... most are considerate and it is VERY hard to quit, but... if these two had a bad relationship, I could see how smoking could easily turn into a means to get on someones nerves.

I would allow her to smoke outside all day long. In fact, I'd put a chair and an ashtray outside the back door and encourage her to smoke early and often. Every smoke she has is one smoke closer to the end.

I smoked for 40 years and found it harder and harder to find somewhere to smoke. I think that as long as its legal, then a smokers rights should be honored and this lady's actions were nothing short of assault! I quit three years ago, which I never thought would happen, but I'm not a reformed smoker that thinks he has the right to judge others for smoking as long as its not prohibited in that area.

I quit about 5-6 yrs ago. I believe strongly that people should be able to smoke any where they please as long as it's not near a place that would explode.
With that said, I truly can NOT stand to be around the smell of cigaretts. They stink to high heaven. Yet I would put up with it, before I'd make someone quit smoking. It goes along the (I'm sick of government restricking everything we do in the name of whatever they choose to name it).
As far as YOUR health goes, I don't really give a crap. I have enough trouble worrying about my own health. I can only suggest you get on your knees and surrender to God, so you can go to heaven where it will be a perfect world:)

People, people, people. Assault is assault. It's not like the smoker walked up to her and blew smoke in her face (that would be assault.) I'm a non-smoker and don't particularly like the smell of cigarette smoke, but I wouldn't start spraying chemicals on someone because of it. It's a matter of degree, but really, what's the difference between what she did and if she had pulled out a gun and shot the smoker?

@Manny Dies.. when you stop eating cheeseburgers and drinking Diet Coke with saccharin, I'll stop smoking. Also, I expect you to be exercising every day and you had better stop driving a car. Let he who is without sin cast the first stone. Heart Disease is a bigger killer than lung cancer and fat-fueled over consumption is the chief cause.
Nobody ever died from second hand smoke. If they did, truck stop waitresses from across the country would be dropping dead.

Glade contains a propellant which is highly flammable, consisting of propane and butane. So basically spraying someone with Glad is like spraying aerosol gasoline on them.
I'd say a gasoline spritzer is far more dangerous than any real or perceived danger from secondhand smoke. Besides, that stupid lady probably inhaled more secondhand smoke sitting outside spraying the woman than she would have if she just ignored it. What a loon. She needs to be put in prison for assault. She even said that she'd do it again.. that represents a continuing threat which means prison is appropriate. Get violent criminals off the street.. especially ones assaulting people with highly flammable fuels.
It is LEGAL to smoke. It is not legal to spray propane on someone. Personal feelings on smoking aren't relevant to this discussion because we're talking about a crime committed in retaliation for a legal act. Should we be allowed to kick babies because they cry too much? I have a "right" to not have to listen to screaming brats. After all, my ears could be damaged.

I could totally see the apartment dweller get so fed up that she flipped, if the smoker was standing outside her door and purposefully smoking there, knowing how frustrating it was to the apartment dweller. In 8th grade, I went on an overnight trip. I was in a room with three other girls and two beds. I went to bed earlier than the others, and rather than just do normal things like talk or watch TV, one of them started jumping on the bed I was in like it was a trampoline. While I was trying to sleep. Her argument (when one of the other roommates asked why she was doing that) was that it was her bed, too, and she could do whatever she wanted.
I don't know if that's the attitude this smoker had, but I could certainly understand the non-smoker's frustrations if it was.

UH - if smokers die earlier than non smokers, than the health care drain would be your 100 year old-alzheimers-diaper wearing-fall and break a hip-living on government dollars ass. I'd rather die young and smoke than be old and a drain.
