He should take this to trial. If I was on his jury I'd find him not guilty.

By some odd chance I happen to know quite a few folks from Oklahoma, and they don't seem to think "okie" is offensive. There are a large number of Oklahoma-based entities that use that term - a radio station in Muskogee, a newspaper somewhere, (I forget the town), and lots of other Oklahomans use the terms same any other state nickname. It isn't the 1930's anymore...
JDog must have been trying to start trouble.

When I was a teenager, a kid I went to high school with thought it would be a good idea to snatch a case of beer from a truck that was making a delivery. NOT. I don't even think he & his chums got to drink a beer apiece before the cops swooped down on them. Not much happened to them, just probation (if anything) if I recall, this was 30 years ago. I remember thinking the kid who did it had to have the biggest (you-know-what) to actually run up to the truck and grab that beer. Now, of course, I realize he was just being stupid. Looks like times haven't changed much where dumb beer-drinking rednecks are concerned!
