An Oklahoma judge has refused to dismiss a first-degree murder charge against the pharmacist.
Prosecutors claim that during the robbery attempt, Jerome Ersland shot the 16-year-old boy in the head. As he was laying unconscious on the floor, Ersland then allegedly shot the boy five more times.
