Patient was raped at psychiatric hospital, prosecutors say
Tony Rizzo has more here about a Research Psychiatric patient who was allegedly raped by another patient last month.
The 47-year-old woman told police that she was asleep in her room at Research Psychiatric Center in Kansas City on June 13 when she awoke and found that Maggard was having sex with her.
She said she was groggy from medication and unable to push him off her.
Hospital staff later told detectives that the type and dosage of medication she was on would have effects similar to GHB, a “rape drug” sometimes used by criminals to incapacitate a victim and affect her memory.

Sentencing is set for tomorrow in Jackson County, the prosecutor's office reports. Johnson was convicted of grabbing a 9-year-old girl off a Kansas City street and raping her. It happened in 1996, but crime-scene evidence was matched to his DNA last year.

No trial for alleged john, age 94
Florida authorities have decided NOT to prosecute a 94-year-old man who allegedly paid an undercover officer for oral sex. Besides having dementia, the man "enjoys flirting with pretty women and never had any intention of paying for sex," his attorney asserts.

Canada is surprisingly OK with drunken teenage sex
A Canadian man was accused of sexual assault because he allegedly had sex with a 14-year-old girl when he was 19. The judge partly cleared him because the girl drank so much that she might have given consent and then forgot, the judge explained.
But the guy ended up getting convicted anyway:
But McIntyre did find Niebergall guilty of sexual assault for placing his genitals on the girl's face after she passed out -- an act the offender captured on his cellphone camera and showed to co-workers.

OP woman gets house arrest for lying about sex with inmate
Jennifer Stambaugh used to work as a case manager for the Bureau of Prisons. She pleaded guilty a couple of months to lying to a DOJ investigator, who'd asked if she had ever had sex with an inmate while he was in custody. She has been sentenced to six months of house arrest, plus six months of probation and a $3K fine.

20-year sentence in brutal KC rape
O’Brian L. Jones pleaded guilty in May, admitting that he and another man repeatedly sexually assaulted the woman after breaking into her home. Afterward, Jones and his companion poured bleach over the woman and rubbed alcohol onto her body in an attempt to destroy DNA evidence they may have left behind.
The men also walked through the woman’s house with trash bags, stealing clothing from her children’s rooms, an X-box and food from her refrigerator. They drove her to her credit union and forced her to cash a $935 paycheck, which she earned as the night manager of a fast-food outlet.

Should sex offenders be allowed to have pornography?
Well, the Florida Supremes say yes, they can, so long as it isn't related to their "particular deviant behavior pattern," the Naked Politics blog reports.
The case involved an RSO who'd done time for lewd or lascivious battery to a 15-year-old boy. He was caught with porn featuring youngish-looking men, though nobody could prove they were underage. This was OK with the Florida Supremes ...
UPDATE: Wisconsin trio planned to dig up corpse for sex
Originally, the charges were kicked because Wisconsin didn't a law against necrophilia. However, the Wisconsin Supremes now say it IS legal to charge someone with sexual assault, even if the victims are already dead. So the attempted-corpse-sex charges have been reinstated.
Former NY prosecutor had sex with teens, including daughter's boyfriend
Beth Modica is getting two years for having sex with two teenage boys. Her attorney says it was "devastating" when her 16-year-old daughter said Ma should go to prison. Snip:

Story is from Columbus; the boy was working as a baby sitter. The woman, 23, has agreed to a plea deal -- she'll cop to a reduced felony count of attempted aggravated indecent liberties with a child. Sentencing hasn't happened yet, but she will be required to enroll as a registered sex offender.

Should sex offenders be banned from volunteering at churches?
A new law takes effect next month in Georgia, and it would do exactly that. No church choir, no cooking for church meals, nothing, or else it's a 10- to 30-year sentence. Some sex offenders are suing to stop the law, saying it's unfair. A few churches oppose it, too, saying it contradicts their mission of forgiveness and rehabilitation. Lawmakers say they're trying to protect innocent people from RSOs who might relapse.

Guilty verdict for the Westport rapist
A Jackson County jury on Thursday found Shy Bland guilty of 12 rapes, five attempted rapes and 14 other charges.
Bland, 52, was convicted of crimes attributed to the so-called Westport rapist, who terrorized the city by assaulting at least a dozen women more than two decades ago.
The victims, 21 to 40 years old, lived alone or with children in Westport or the West Plaza areas near where Bland lived. He stalked them and most often entered their homes through windows late at night wearing a mask and with a knife in his hand.
He raped one woman as she clung to her baby daughter. Another who fought him suffered bruises and a broken nose but escaped.

KC man found covered in baby oil, exposing himself -- 3rd time in 3 years, police say
Kansas City police arrested a partially naked man covered in baby oil Monday after he allegedly exposed himself to a woman outside a daycare center.
It was the third time in three years that police pulled over Larry D. Booker, 53, and found him glistening in oil. The previous incidents occurred in January in Kansas City and in 2005 in Lenexa.
Jackson County prosecutors have not yet charged Booker with Monday’s alleged exposure, but police locked him up on a warrant for failing to appear in court for his January charge.
The latest incident occurred about 8:30 a.m. Monday, when a 47-year-old female motorist saw a man get out of his vehicle in front of a daycare center in the 6100 block of the Paseo wearing a white robe and nylon stocking cap. The man opened his robe, exposing his genitals, and returned to his vehicle, the woman told police.
A few minutes later, a police captain who had heard of the incident pulled Booker over near 62nd Street and Tracy Avenue. Booker wore a white robe, no shirt and black sweat pants, and he was slathered in baby oil, according to a police report.

A Pennsylvania man accused of raping a 13-year-old girl says he's innocent because his genitalia is too big. (The rape kit found no tears or injuries, the local TV station reports.) His attorney wants a plastic cast taken of the man's privates so it can be shown to the jury.
"It started out when I interviewed people who knew my client on a personal basis who said that I should know that he was absolutely unusually, almost a freak of nature," Gold said.

One of the lawsuits makes claims against Monsignor Thomas O’Brien, who has been named in at least a dozen other similar cases, The Kansas City Star reported. It was filed by the mother of a man who died in 1999 in a car accident.
The second case accuses Earl Johnson, a member of the Capuchin order, of sexually abusing another man 30 years ago.

Just how private is a public bathroom, anyway?
Nine guys were arrested during a sex sting in a Sears bathroom in Daytona Beach last year, but one of them has gotten most of the evidence thrown out. The judge says that, when the defendant entered the toilet, he had a reasonable expectation of privacy. (No matter what the undercover officer saw through the gaps in the stalls.) Snip:
“If someone goes into a restroom, closes that restroom door, they are then expecting themselves to be removed from the remainder of society,” defense attorney Mike Lambert said.

Attacker put knife to baby's throat, rape victim says
A 28-year-old woman told police that an acquaintance raped her early Thursday in the 1500 block of Lexington Court. The woman said she had met him Wednesday and allowed him into her home. About 3:20 a.m. Thursday, he put a knife to her 7-week-old baby’s throat and demanded sex, she said, before raping her and stealing her purse.

That headline is courtesy of the SF Chronicle -- it just couldn't be improved upon. The gropee here was a sheriff's deputy; it sounds like he was undercover, or as undercover as one can be at a nude beach. The priest has been banned from the area, which is named Pirates Cove.
Is this man the Westport Rapist?
Joe Lambe has a piece on the trial of Shy Bland, who's accused of sexually assaulting a dozen women in 1985 and 1986. KCPD believes he's the infamous Westport Rapist, a particularly violent attacker who would break into women's homes and force them into sex.
A lot of the case hinges on DNA evidence, which the defense plans to attack. Snip:
Defense lawyer Theresa Lininger-Morman told jurors that the attacks happened in another era, a time when Ronald Reagan was president and the Royals won a World Series.
When DNA testing did not exist, police knew nothing about how to preserve evidence to keep it from being contaminated, she said. Some of the lab testing that was available then contradicted the later DNA results, she said.

The New York Times reports on a woman who was raped and tortured for 19 hours:
The accused, Robert A. Williams, 31, had doused the woman’s face and body with boiling water and bleach, forced her to swallow handfuls of pills and to chase them with beer, sealed her mouth with glue, and bound her wrists and legs with shoelaces, cords and duct tape, said the prosecutor, Ann P. Prunty. And now, Ms. Prunty said, he was asking the woman to gouge out her own eyes with a pair of scissors.
And so the woman, sitting on the floor of her studio apartment in Hamilton Heights and holding a pair of scissors between her knees — the blade pointing toward her face — tried to stop the suffering. She lowered her face to the blade, but turned her head at the last moment, trying to stab herself in the neck instead of her eyes.
The scissors slipped from her grasp, the suicide attempt failed, and the woman suffered several more hours of torture, Ms. Prunty said.
He wanted her blind so she wouldn't be able to identify him, police say.
When is a rape NOT a rape?
If you missed it, Tony Rizzo had a good story this weekend talking about a case we've debated here before. It's the story about a woman in Nebraska who says she was raped -- even though the judge in her case refused to let her use that word or terms like "victim" or "assailant."
The judge and the defense say it isn't fair for an accuser to describe something as a rape if nobody's proven that it was, in fact, a rape. But victims advocate say it's also wrong to soften testimony by describing a sexual assault as "intercourse."
Nobody gets out alive
Like a lot of states, Minnesota has a process called "civil commitment" -- they'll take a convicted sex offender, and if experts believe there's a high chance they'll reoffend, the convict gets put into a state-controlled rehab program until he's cured, even if it takes years and years beyond the original sentence.
It's been 14 years, and nobody's "graduated," the Star-Trib reports. The only ones who "complete" the program are the guys who, well, die in custody.
That's not a huge problem, if you want to just lock them up and throw away the key. But it costs about THREE TIMES as much to "treat" these guys. Maybe we should check into buying them an island.

Mohave County Superior Court Judge Steven Conn dismissed the charges on Wednesday at the request of the defense, finding that a state incest law does not apply to the arranged marriages of two teenage girls and their older male relatives.
Conn ruled the law only applies if both participants in the sexual activity are older than 18, and that the law does not apply to half cousins.
See? Everything's cool -- the girls were all younger than 18.

OP man acquitted of molesting girl at Northland casino
A Clay County jury on Tuesday acquitted an Overland Park man who was accused of molesting a 9-year-old girl inside a restroom at the Ameristar Casino Hotel.
The jury took less than an hour to return the not guilty verdict against Zia Uddin. Authorities had accused Uddin of assaulting the girl on Aug. 31 while her mother was in a restroom stall at the casino at 8201 N.E. Birmingham Road.
David Kelly, defense attorney for Uddin, said his client erroneously went into the restroom and no assault occurred. Uddin was in the women’s restroom for only 20 seconds, Kelly said. “We are gratified the jury saw the evidence for what it was,” he said.

Guilty verdict in KC rape from 2000
Ray Anthony Slaughter, 38, was linked to the assault when a DNA sample he gave after an arrest in California matched DNA evidence from the June 2000 assault.
The woman, who was 19 at the time, testified last week in Jackson County Circuit Court that Slaughter raped her and threatened to kill her if she told anyone. Slaughter testified that the encounter was consensual.
Although the victim immediately reported the attack, charges were not filed until 2006 when the DNA match was made while Slaughter was imprisoned in California on drug charges.

So the attorney for R. Kelly makes a big deal about the fingernail-size mole on his client's back. The lawyer goes so far to say that, if the guy on the sex tape doesn't have the mole, it simply cannot be R. Kelly.

A Palm Beach Gardens man and his mother, a middle school science teacher, are permanently barred from owning or possessing animals, a judge ruled Thursday after watching a short film of the man having sex in his bedroom with a German shepherd.
Apparently the mother, who said she had no knowlege of the acts, is banned from owning pets forever.
