Why play the race card?
Let me get this straight. A group of New Haven, Conn., firefighters all took a test for promotion. They all probably have similar seniority, give or take a couple of years. The white firefighters pass, while the minority firefighters do not. And the test was thrown out and called illegal? (7/10, Opinion, “Pro-con”)
Am I the only one who finds this completely insane? Do you think if it were the other way around, the test would have still been thrown out? I think we all know the answer to that.
Why is it that it always comes down to race? Nobody is smarter than another just because of skin color. Maybe one group just decided to study hard and do what was needed to pass, and the other group didn’t. Maybe it’s just that simple.

Editor’s note: The Supreme Court last month threw out the decision in the New Haven firefighters’ case that high court nominee Sonia Sotomayor had endorsed as an appeals court judge.

I also love how liberal groups, such as People for the American Way (sic), are going after Ricci because he dared file a civil rights claim. You should be very proud of that. I'd be worried if I were one of the other 16 people in the case who also had their civil rights violated.

My rhetoric is accurate. When you can invalidate an objective test because blacks didn't score high enough, then 1) You're crazy; 2) You are discriminating.
SCOTUS got it right. The wise Latina, not so much.

thanks for the legal analysis Roger, but it came down to whether or not the City would be liable under the disparate-impact staute.
The federal district court Judge - Yes
The three judge 2nd Circuit Court of Appeals - unanimously yes.
The SC - Five no, four yes.
Obviously it is not the 'discriminate against white people' rhetoric that you are so desperately clingin to.

You make a good point, but probably not the one you expect. It indeed does saying something about the 4 left-wing judges on the Court that they do not believe it is possible to discriminate against white people. That disparate impact should be the law of the land.
Feel free to defend that horror show if you must.

I agree with T.J. but its America, It’s sad but the only thing that has changed (Thank God) is equal rights lol, sorry that wasn’t funny; Race is a closet issue but when someone has the balls to say something in public it takes you back 100 years
